Michael Moldenhauer (Mississauga) - and our story

My wife and I put down our good money for enhancements to our town house, yet to be built.  The project was canceled by the builder, Moldenhauer Lifestyles - Clarkson Manor Inc. - Michael Moldenhauer.

Then we started to try and get our deposits back.

This was a horror story.

First he would not return the deposits in trust.  Tarion Corporation eventually got this done, so we recovered the larger deposit.

Then we attempted to get the deposits for the pot lights, patio deck, back door and wine cellar.

He has told me under no uncertain terms - 'Dan, you must pay for the actions you have taken.  You will never get that money, instead you will have to pay me'.

I really don't get this.  How could some one take money as a deposit for development of your house, and the things to make it a great home, cancel the project and then not return the monies.

There are always two sides to the story.  Before you put a deposit down on anything, please ask Michael Moldenhauer about the story with Dan and Tammy Davis.

If you want more details and other versions, ask the other owners of the same town house complex what happened to them.  Ask the city building department - John Hardcastle what happened.  Ask Pat Mullin, the ward 2 councillor.

Most importantly, ask yourself how to get your deposit back, if the builder refuses to give it back and yet does not deliver anything and cancels the project.  Be very detailed - lawyers and court did not effectively work - it would have consumed the deposit and the damages would have been 'behind' the millions of dollars of judgements against the property from others yet owed their monies or deposits.
